OPEN TO KOOLRED MEMBERS FROM ALL COUNTRIES WHO ARE AT LEAST 18 YEARS OF AGE AS OF THE DATE OF ENTRY

All entries submitted will remain on www.koolred.com even after the expiry of the Contest. No requests for removal of the entries will be entertained.

By submitting an entry for this contest, you accept and agree to these terms and conditions. The decisions of the organizer regarding this Contest are final and binding in all respects.

CONTEST PERIOD. The Colourful Photo contest [“Contest”] is organised by Koolred Sdn Bhd [“Organizer”]. The Contest will commence from: 10:00 (GMT+8) 28 July 2011 and end 16:59 (GMT+8) on 26 August 2011 [“Contest Period”]. The Contest results will be announced on 8 September 2011.
Note: Only photos received by the Organizer at or before 16:59 (GMT+8) on 26 August 2011 will be deemed eligible for entry.
ELIGIBILITY. The Contest is open to all members of Koolred from any country who are at least 18 years of age as at the date of entry [“Participants”] except the directors, members and employees of AirAsia Berhad, Koolred Sdn Bhd and its immediate family members.
CONTEST MECHANISM. To qualify for the Contest, Participants will have to do the following:
1. Be a registered member of Koolred(http://www.koolred.com).
2. Upload a *Colourful photo relating to and under the following tags:
  - Animals
  - Entertainment
  - Festivals & Events
  - Food & Drink
  - Kids
  - Lifestyle
  - Music
  - People
  - Sports & Auto
  - Technology
  - Travel
  *Colourful means your photo must have all 4 primary colours (yellow, green, blue and red) or one single colour in 4 different shades making up at least 30% of the photo. Winning photos will be determined by a panel of judges. The judges’ decision will be final and no correspondence will be entertained.
3. Caption the photo in English with the location and country where the photo was taken in.
4. Answer three (3) accompanying questions.
5. Share the photo submission on the website http://www.koolred.com and get friends to click on the Kool icon.
All entries submitted for the Contest becomes the sole property of the Organizer and will not be acknowledged or returned. Any entry submitted must be the work of the Participant submitting the entry and must not have been published elsewhere or have won a prize in any other photography contest. It is the responsibility of each Participant to ensure that any image submitted has been taken with the permission of the subject and does not infringe the copyright of any third party or any laws. Each Participant warrants that each entry submitted is his / her own work and that he / she owns the copyright for it.

Proof of submission of an entry shall not be deemed proof of receipt by the Organizer. The Organizer is not responsible for entries not received due to difficulty of accessing the internet, service outage or delays, computer difficulties or other technological glitches. Inappropriate photos as deemed by the Organizer will not be posted or entered for judging.

Members may submit an unlimited number of photos. All submitted photos will be reviewed by the Organizer and only those approved by the Organizer will be displayed on the website http://www.koolred.com. This process may take up to 1-2 working days.
CONTEST DEADLINE. 16:59 (GMT+8) on 26 August 2011 (the “Contest Deadline”). The Organizer reserves the right to extend the Contest Deadline if it deems fit to do so.
CONTEST DISQUALIFICATION. Only complete entries submitted by Participants which fulfil the terms and conditions of the Contest shall be eligible for the Contest. The Organizer reserves the right to disqualify any entries without prior notice for any reason whatsoever.
Reasons for disqualifying Contest entries include without limitation to the following:
1. Photos which are not within any of the following tags: Animals, Entertainment, Festivals & Events, Food & Drink, Kids, Lifestyle, Music, People, Sports & Auto, Technology, Travel;
2. Photos with illustrations, digital super imposition, composite photographs, trick photographs, or and any form of digital imaging or image manipulations. Only minor photo touch-ups such as cropping, adjustment of brightness and colour as well as softening or sharpening of the image are permitted.
3. Incomplete or illegible entries;
4. Entries that contains material suspected of being intellectual property of some other person or entity and cannot be proved to be original;
5. Entries which do not fulfil the contest mechanism;
6. Entries containing links to external third-party sites which has no significant value to the Contest;
7. Entries which contains defamation, misrepresentation or disparaging remarks;
8. Entries which are sexually explicit, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic, obscene or offensive;
9. Entries which promote the consumption of alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing) or a particular political agenda.
WINNER SELECTION AND NOTIFICATION. Winning photos will be selected based on criteria below:
1. Total ‘Kool’ icons received for the entries before or on the Contest Deadline;
2. Correct answers for the three questions posted.
3. The decision of a panel of judges as appointed by the Organizer based on the most colourful, creative or interesting entries submitted in their sole discretion.
The Organizer may also consider how dormant or active the Participant is on Koolred and the number of times his/her photo was shared on Facebook and Twitter using the respective Facebook and Twitter ‘Share’ links visible on top / bottom of each photo entry.

The winners for the Contest will be contacted after the Contest Period, at any time and via email or any other mode of communication deemed appropriate by the Organizer. If a potential winner cannot be contacted, does not respond within five (5) days from the date the Organizer first tries to notify him/her, and/or the prize or prize notification is returned as undelivered, the potential winner will forfeit the prize, and the Organizer reserves the right to select an alternate winner in its sole right and discretion.
PRIZES. Three (3) main prizes and forty seven (47) consolation prizes will be awarded for the Contest. The winners will receive either one (1) of the following:
- 1st Prize: TWO (2) return AirAsia flight tickets from Kuala Lumpur-LCC Terminal to Guangzhou.
- 2nd Prize: TWO (2) return AirAsia flight tickets from Kuala Lumpur-LCC Terminal to Kochi.
- 3rd Prize: TWO (2) return AirAsia flight tickets from Kuala Lumpur-LCC Terminal to Myanmar.
- Consolation Prizes: FORTY SEVEN (47) Airasia Exclusive Merchandise.
The prizes do not only include transportation to and from airports, travel insurances, meals, baggage allowance, taxes, administration fees, additional hotel charges, other chargeable add-ons and other costs of personal nature incurred by the winner(s) and/or their guests in connection with their use of the prizes and the winner(s) and/or their guest(s) shall be solely responsible for any payment of the same which are payable in connection with their use of the prizes. Both winner and guest must travel on the same itinerary and are responsible for obtaining all required travel documents. In addition, such guest must be 18 years of age or older.

Please note that the travelling period may be subjected to certain restrictions for use including without limitation blackout dates.
PRIZE DELIVERY. In the event that a prize or prize certificate is to be mailed to the winner, it will be with the prior written consent of the winner and in the event thereof, the winner will assume the risk of its loss during the delivery process. The Organizer will not be responsible for the safe arrival of the prize or prize certificate.
NO PRIZE TRANSFER OR SUBSTITUTION. The prizes are not exchangeable and/or transferable or redeemable for cash. Any portion of the prize that is not used is forfeited. No substitutions for prizes are allowed unless made by the Organizer, in which case a prize of equal or greater value will be substituted at the Organizer’s sole discretion.
CONSENT AND RELEASE. By entering the Contest, each participant releases and discharges the Organizer, and any other party associated with the development or administration of the Contest, their parents, subsidiary, and affiliated companies, and each of their respective directors, members, shareholders, employees, contractors, agents, representatives, successors and assigns from any and all liability whatsoever in connection with this Contest, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, 'Claims').

The Organizer reserves its rights to publish or display materials or information, including but not limited to the names and photographs of all Participants for marketing, advertising and publicity purposes in any manner it deems appropriate. The Organizer further reserves its right to use any personal data of Participants in any manner and/or for any purpose it deems fit and participant is deemed to consent to such use with no monetary payment.

The Organizer reserves its right to cancel, terminate or suspend the Contest with or without any prior notice and reason. For the avoidance of doubt, cancellation, termination or suspension by the Organizer shall not entitle the participant to any claim or compensation against the Organizer for any and all losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.

The terms and conditions herein shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the Contest. In the event of any inconsistency, conflict, ambiguity or discrepancy between the English version and the Bahasa Malaysia version of these terms and conditions, the English version shall prevail at all times.

The Organizer reserves its right to vary, delete or add to any of these terms and conditions and/or substitute or replace the gifts or any part thereof from time to time without any prior notice.

By participating in the Contest, it is deemed that the participant agrees to be bound by the terms and subject to the conditions herein set out upon submission of entry. The decisions of the Organizer in relation to every aspect of the Contest including but not limited to the type of prize and winner shall be deemed final and conclusive under any circumstance and no complaint from any participants will be entertained.
INDEMNITY. By entering into the Contest, each Participant agrees to hold harmless, defend and fully indemnify the Organizer from and against all losses, damages, expenses and all third party actions, proceedings, claims, demands, costs (including without prejudice to the generality of this provision, the legal cost of each other), awards and damages arising as a result of the Participant’s entry to the Contest.
